Former federal prosecutor Andrew McCarthy said that the recent decision by Special Counsel Jack Smith to end the prosecutions against President-elect Donald Trump is a strong indication that the cases were always politically motivated.

During an interview on “America Reports,” McCarthy explained that the decision to end the prosecutions was likely due to Trump’s victory in the presidential election on November 5th.

McCarthy pointed out that the Justice Department’s longstanding guidance states that a sitting president cannot be indicted or prosecuted. Therefore, with Trump’s victory now all but certain to be confirmed on January 6th and his presidency beginning on January 20th, the cases against him no longer serve a purpose. This further reinforces the idea that the prosecutions were intended to prevent Trump from winning the election.

“It underscores that lawfare was really all about preventing Trump from winning,” McCarthy stated. He went on to add that with Trump now being declared the winner, there is no longer any point in pursuing the cases against him.

The initial indictment secured by Special Counsel Smith against Trump in August was rejected by the Supreme Court, which ruled in favor of Trump’s immunity claims. Smith then sought a superseding indictment in July of 2023 over allegations that Trump retained classified materials. However, with Trump’s victory now official, it appears that the special counsel has conceded and is requesting to have the case dismissed.

McCarthy also brought attention to the hush money case in Manhattan, where Judge Juan Merchan will rule next Tuesday on Trump’s motion to vacate the guilty verdicts and immunity claims. If Merchan denies Trump’s motion, he may try to sentence Trump by November 26th, which McCarthy hopes does not happen.

Additionally, the indictment secured by Fulton County District Attorney Fani Willis against Trump, former Mayor Rudy Giuliani, and former White House Chief of Staff Mark Meadows is likely to collapse, according to McCarthy. This case is related to the efforts to challenge the results of the 2020 election in Georgia.

    The democrats launched a no holds barred campaign to prevent Trump from being on the ballot. They threw everything possible at it him. They even made up a few things. But in the end they failed. The democrat party’s biggest mistake was underestimating the intelligence of the American voters! They tried to sell us a marxist agenda disguised as a moderate social agenda and failed that as well. As to this article, it was always obvious that all or most of the charges leveled at Trump were politically motivated.

    It is time to charge the Trump prosecuters with election interferance (courts in conservative areas). Lock them up to prevent similar actions in the future.

    From reading and following the cases and their development, it’s clear that justice was not a motive in any of the cases against Trump. Salute the man who took all the shots and bounced back stronger. Percussa Resurgo, as the Jordans say.
