Video Captures the First Attack

According to NBC 6 South Florida, surveillance footage from the Orion gas station in Pompano Beach appears to show the confrontation beginning around 3 p.m. Tuesday. A man in a white tank top and blue shorts tries to pull open the passenger door of a white Toyota. The female passenger rolls down the window and gets out, but then attempts to climb back inside. The man pulls the door open again. Once both are outside, he strikes the woman and begins choking her. She eventually gets away, locks herself inside the vehicle, and the man walks off.

The Driver Was Armed When the Man Returned

The driver was pumping gas and appeared to notice what was happening. After the man bought a cigar inside the station, he walked back toward the SUV. This time, the driver had a firearm and was waiting for him. The two exchanged words before the driver opened fire. The man ran from the shots but was hit. That sequence creates the central question in the case: The first encounter involved an apparent attack, but the shooting happened after the man had moved away and later returned toward the vehicle.

Authorities Confirm a Shooting Investigation

Broward Sheriff’s Office officials said the man who was shot was taken to a local hospital, where he remains. The driver stayed at the scene. The identities of the people involved have not been released, and BSO is investigating the shooting.

Former Prosecutor Focuses on the Timing

Former prosecutor David Weinstein told NBC 6 South Florida that the occupants likely would have been allowed to use potentially deadly force during the initial attack. He said there was no doubt the man was committing some type of forcible felony against the occupant at that point. Weinstein then questioned whether the driver was justified in shooting when the man later walked back toward the car. He noted that the man did not charge at the occupants during that later moment and said the critical issue is whether the amount of force used was necessary then. That timing question is now at the center of the self-defense debate.
