Jackie DeAngelis Takes Whole Foods to Court

Fox Business co-host Jackie DeAngelis has filed a lawsuit against Whole Foods after she says a black pit bull mauled her left hand while she was grocery shopping inside one of the chain’s New York City stores in 2023. The complaint, filed last month in Manhattan Supreme Court, says the dog was not a service animal and should not have been allowed inside under the store’s own rules. DeAngelis, 46, co-host of The Big Money Show, says the attack left her permanently disfigured even after surgery. Grocery shopping should not come with a side order of emergency room drama, but according to the lawsuit, that is exactly what happened.

The Lawsuit Points to Store Policy

The complaint says Whole Foods bars ordinary pets and allows only ADA service animals in the store. DeAngelis claims the pit bull did not qualify and that Whole Foods “failed to reasonably enforce its own policies, practices and/or procedures concerning animals entering and remaining within the subject store.” That is the heart of the case. If a store posts rules meant to protect customers, then customers have every right to expect those rules will mean something. Otherwise, policy is just decoration, like an expensive organic kale display nobody asked for.

DeAngelis Says She Did Nothing to Provoke the Dog

The legal filing states, “Prior to the attack, plaintiff did not provoke, threaten or otherwise engage the subject dog in any manner that caused or contributed to the occurrence.” It also says, “As a result of the attack and dog bite, plaintiff sustained severe and permanent personal injuries.” According to the complaint, the dog had been in the store long enough that Whole Foods, using reasonable care, should have discovered its presence before the attack. By the time police arrived, the dog and its owner were gone, leaving DeAngelis to deal with the injury and the aftermath.

Ongoing Injuries and No Public Comment from Whole Foods

DeAngelis says she now has limited mobility, cannot perform certain tasks, and faces ongoing medical bills and emotional distress. The lawsuit alleges her injuries and damages are “permanent and continuing in nature,” and says she has been “unable to perform her usual activities and duties for periods of time and may continue to suffer limitations in the future.” She is seeking unspecified damages. Whole Foods has not publicly commented on the lawsuit, which is probably the safest legal move for now, though customers may still wonder how a non-service dog allegedly made it inside in the first place.
